Welcome to Sun Keep ("I," "me," "my"). These Terms of Service ("Terms") govern your use of my website sun-keep.com and any design services purchased through it. By placing an order or using this site, you agree to these Terms. If you do not agree, please do not use this site or purchase my services.

1. Services Offered

I provide custom digital graphic design services, including but not limited to logo design, branding, social media graphics, etc. I do not sell or ship physical products. All deliverables are provided digitally (e.g., via email, download link, or file transfer).

2. Orders & Payment

  • All prices are listed in CAD and are due in full at the time of purchase unless otherwise stated.
  • By placing an order, you confirm that the information you provide (project details, brand assets, instructions, etc.) is accurate and that you have the right to use any materials you submit to me.
  • I reserve the right to refuse or cancel an order at my discretion, including before work has begun, in which case you will receive a full refund.

3. Turnaround Time & Revisions

  • Estimated turnaround times are provided at the time of purchase or in your order confirmation. These are estimates, not guarantees, and may vary based on project complexity or current workload.
  • 3 rounds of revisions are included with each order. Additional revisions beyond this may incur extra fees.
  • Delays in your response time (e.g., providing feedback or materials) may extend the overall delivery timeline.

4. Refunds

All sales are final once work has begun. Please see my full Refund Policy for details.

5. Intellectual Property & Usage Rights

  • Upon full payment, you receive a licence to use / full ownership of the final delivered design files for the purposes outlined in your order.
  • I retain the right to showcase completed work in my portfolio, website, or social media unless you request otherwise in writing.
  • I am not responsible for ensuring that submitted materials (logos, images, text, fonts, etc.) you provide are free of third-party copyright or trademark restrictions. You are responsible for securing rights to any content you ask me to use.
  • Unless otherwise agreed in writing, I retain ownership of preliminary concepts, drafts, or unused design options not selected as the final deliverable.

6. Client Responsibilities

You agree to:

  • Provide timely, accurate information and feedback needed to complete your project.
  • Only submit content you have the legal right to use.
  • Review final files upon delivery and report any errors within 5 days.

7. Limitation of Liability

To the fullest extent permitted by law, Sun Keep is not liable for any indirect, incidental, or consequential damages arising from the use of my services or design deliverables, including but not limited to lost profits, business interruption, or third-party claims related to your use of the final designs.

8. Changes to These Terms

I may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the site or services after changes are posted constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.
